By accessing or using Energy Pacific's website, services, or products (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use our Services. By using our Services, you represent and warrant that you meet these requirements.
For business and commercial accounts, you represent that you have the authority to bind the business entity to these Terms.
3. Electric Utility Services
Energy Pacific provides electric utility services subject to applicable laws, regulations, and tariffs filed with the Oregon Public Utility Commission.
Service Agreements: By requesting service, you enter into a service agreement with Energy Pacific. The terms of your specific service plan, including rates, billing cycles, and contract terms, are governed by your service agreement and applicable tariffs.
Service Availability: We strive to provide reliable electric service but do not guarantee uninterrupted service. Service may be interrupted for maintenance, emergencies, weather events, or other circumstances beyond our control.
Metering and Billing: You agree to allow Energy Pacific access to your property for meter reading, maintenance, and service connection/disconnection. You are responsible for payment of all charges for electricity consumed at your service address.
4. Account Registration and Security
To access certain features of our Services, you may need to create an account. You agree to:
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate your account if any information provided is inaccurate, fraudulent, or violates these Terms.
5. Payment and Billing
Payment Terms: Bills are due by the date specified on your statement. Late payments may be subject to late fees and/or service disconnection as permitted by law.
Payment Methods: We accept various payment methods including automatic bank draft, credit card, check, and online payment through MyAccount.
Autopay: If you enroll in autopay, you authorize Energy Pacific to automatically charge your designated payment method on the due date. You may cancel autopay at any time through MyAccount or by contacting customer service.
Deposits: We may require a security deposit for new accounts based on credit evaluation. Deposits are held according to applicable regulations and may be refunded after a satisfactory payment history.
6. Limitation of Liability
To the fullest extent permitted by law, Energy Pacific shall not be liable for:
• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Damages resulting from service interruptions or outages
• Damages caused by third-party products or services
• Damages exceeding the amount you paid to Energy Pacific in the twelve (12) months preceding the claim
Our total liability to you for any claim arising from or relating to these Terms or our Services shall not exceed the amount you paid to Energy Pacific in the twelve (12) months preceding the claim.
7. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Energy Pacific or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.
8. Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions.
Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Portland, Oregon, administered by the American Arbitration Association.
You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Multnomah County, Oregon.
